Kanye and Kim Kardashian West have filed a lawsuit against one of the co-founders of YouTube for leaking footage of their October 2013 marriage proposal. Billboard says, the Wests are likely to win their lawsuit against Chad Hurley, who posted footage of their proposal on his news site, MixBit. Hurley, who attended the elaborate event, claims the confidentiality agreement he signed did not bind him from posting the video to his site.
He also says he did not leak the confidential information about the proposal because the proposal was also filmed and aired for Keeping Up with the Kardashians. The Wests’ lawyer believes “Hurley’s new venture, MixBit, was not doing well, he posted the video on MixBit, which provided it with significant publicity, and he did so within hours of leaving the event. A jury may reasonably infer fraudulent intent from these circumstances.”
Hurley’s lawyer refutes these claims by saying it was his client’s First Amendment right to post and protect the video as his own intellectual property. The Wests have not stated how much money they are seeking if they win their lawsuit, but it will be significant ,since their attorney Eric George believes Hurley’s video generated and increased traffic on his site, which has generated a profit.
